Key Points

This is a summary of these terms. The full terms below are organised into a common part that applies to everyone, followed by a separate section for each Qwixl product.

  • By using Qwixl you agree to these terms. If you use the Service for a school or organisation, you confirm you have authority to do so.

  • You may use Qwixl only for lawful purposes. You are responsible for the content you create and the data you upload.

  • You keep ownership of the content you create. You grant us the licence we need to run the Service.

  • Paid subscriptions are billed in advance and renew automatically. We show the price before you subscribe and send a reminder before each renewal. You may cancel at any time, with no cancellation fee.

  • Safeguarding rules apply: a minimum age of 10, verified parental consent for under-13s, and consent for whole year groups where required.

  • Qwixl: Milo provides writing support. Its indicators are not a diagnosis and do not replace professional assessment.

  • Qwixl: Streams lets you publish public content. We may remove or restrict public content at our discretion.

  • The Service is provided "as is". Our liability is capped at the fees you paid us in the prior twelve months, except where the law does not allow that.

  • These terms are governed by the laws of England and Wales.

Part A — Common (applies to all Qwixl products)

1. Agreement to terms

By accessing or using Qwixl ("the Service"), you agree to these Terms of Service. If you use the Service for a school or other organisation, you confirm you have authority to bind that organisation to these terms. These terms apply to the Qwixl website and to each Qwixl product. Product-specific terms are in Part B and prevail over Part A for that product where they differ.

2. Definitions

"We", "us" and "Qwixl" mean the operator of the Service. "You" and "user" mean the person or organisation using the Service. "Content" means the data, text, or materials you upload to or create within the Service. "Products" means Qwixl: Homework, Qwixl: Milo, and Qwixl: Streams.

3. Eligibility and accounts

You must meet the age and consent requirements in section 16. You are responsible for the accuracy of your account details and for keeping your credentials secure. You are responsible for activity under your account.

4. Licence and intellectual property

Qwixl and its branding, software, and design are owned by us. We grant you a non-exclusive, non-transferable licence to access and use the Service for its term. You retain ownership of the Content you create, and you grant us the licence necessary to operate the Service, including to process, store, and display your Content to provide features to you.

5. Acceptable use

You must use the Service only for lawful purposes. You must not: attempt to circumvent security or access controls; abuse our APIs or exceed usage limits; reverse engineer, scrape, or copy the Service except as permitted by law; upload unlawful, infringing, or harmful content; or use the Service in a way that harms others. We may suspend access for serious or repeated breaches (section 12).

6. Subscriptions, fees and cancellation

Subscriptions and top-ups are billed in advance. Before you subscribe we show the price, the billing interval, and what is included. Paid subscriptions renew automatically at the end of each billing period, and we send a reminder before each renewal payment.

You may cancel at any time from your account or by contacting us. Cancellation is as easy as signing up, there is no cancellation fee, and you keep access until the end of the current billing period. If you cancel a free trial before it converts to a paid plan, you are not charged. Refunds are handled in line with our refund policy. You are responsible for keeping your account credentials secure.

7. Changes to the Service

We may change, add, or remove features. Where a change materially reduces core functionality of a paid product, you may cancel the affected subscription and we will refund any prepaid, unused portion.

8. Data protection

We process personal data as described in our Privacy Policy. Where we act as a processor for a school, the school is the controller for that processing, and a Data Processing Agreement is available on request.

9. Warranties and disclaimers

We provide the Service with reasonable skill and care. Except as expressly stated, the Service is provided "as is", and we do not warrant that it will be uninterrupted or error-free. Outputs that support decisions, including screening indicators and writing-quality metrics, are not a diagnosis or professional advice.

10. Limitation of liability

To the fullest extent permitted by law, our total liability to you in any twelve-month period is limited to the amount you paid us in that period. We are not liable for indirect or consequential loss, or for loss of profit, revenue, or goodwill. Nothing in these terms excludes our liability for death or personal injury caused by our negligence, for fraud, or for any liability that cannot be excluded by law.

11. Indemnity

You agree to indemnify us against claims, losses, and costs arising from your Content, your use of the Service, or your breach of these terms, except to the extent caused by our breach or negligence.

12. Suspension and termination

You may stop using the Service at any time. We may suspend or terminate access on notice for breach of these terms, non-payment, or security or legal reasons, and without prior notice where required for security or by law. Where a breach is capable of being cured, we will usually allow a reasonable period to do so. On termination your right to access the Service ends, and we handle your data in line with the Privacy Policy.

13. Changes to these terms

We may update these terms from time to time and will update the "last updated" date above. We will notify you of material changes by email or in-app notice. Continued use after changes take effect is acceptance of the updated terms; if you do not agree, you must stop using the Service.

14. Governing law and jurisdiction

These terms are governed by the laws of England and Wales and are subject to the exclusive jurisdiction of its courts. If you are a consumer, you keep the protections of the law of your country of residence.

Part B — By product

16. Qwixl: Homework and safeguarding

These terms form part of the contract for Qwixl: Homework.

  • Minimum age: the minimum age to create a student account is 10. We use the date of birth provided at sign-up to enforce this.

  • Parental consent for under-13s: a student who is under 13 at sign-up must provide a parent or guardian email. We send that adult a secure link to approve the account, and the student cannot access the Service until consent is given.

  • Year 7, 8 and 9 (UK) and equivalents: access to classes designated as these year groups requires approved parental consent for every student in the class, regardless of whether the student has turned 13.

  • Higher Education and senior-only classes: students under 13 cannot join classes designated as Higher Education or senior-only (for example Year 12 or Year 13).

  • Date of birth: we store a student's date of birth only to apply these age and consent rules. See the Privacy Policy for how we use and protect this data.

If you use the Service as a teacher, you agree to set the correct year group for your classes so that consent and access rules apply. If you allow your child to use Qwixl, you agree to these safeguarding terms.

17. Qwixl: Milo (Chrome extension and Word add-in)

Milo provides SEN-aware writing support inside the document you are working on, as a Chrome extension for Google Docs and as a Microsoft Word add-in. You may use Milo only for lawful, personal or educational support purposes.

Not a diagnosis or professional advice: Milo's indicators, including those relating to typing patterns, focus, or literacy support, are screening-style indicators only. They are not a medical, educational, or psychological diagnosis and are not a substitute for assessment by a qualified professional. You must not rely on Milo for any educational placement, health, or legal decision. We do not warrant the accuracy, completeness, or suitability of any indicator for your circumstances.

Acceptable use: you must not use Milo to harass, mislead, or harm others, or to circumvent security or usage limits. You are responsible for how you use the indicators and for the decisions you make. The limitation of liability in section 10 and the "as is" basis of the Service apply to Milo.

Subscription: Milo is a separate subscription from Qwixl: Homework plans. The billing, renewal, and cancellation terms in section 6 apply. The SEN Evidence Pack is a separate one-time purchase; it gathers structured evidence that may support conversations with SEN professionals and does not diagnose SEN or replace formal assessment.

18. Qwixl: Streams

Qwixl: Streams is available as Streams Student and Streams Pro. You keep ownership of the work you create, subject to the licence in section 4.

Public content (Streams Pro): Streams Pro may let you make content visible on public-facing pages, such as public profiles, stream pages, and discovery. Public visibility is optional. Where you publish, you accept that the content may be found by third parties, including search engines and other automated systems.

Our discretion over public content: we may, at our discretion and without prior notice where we reasonably consider it appropriate (including for legal, safeguarding, security, reputational, or operational reasons), remove, unpublish, delist, restrict, or refuse to display any public Streams content, profile, link, or metadata, whether or not you have met any technical or account condition for publishing. We are not obliged to host, publish, promote, or index any particular content.

We may act where we reasonably consider that content is, for example: spam or bulk unsolicited promotion; intended to manipulate search rankings or generate artificial traffic; misleading, impersonating, or misrepresenting; harmful, abusive, harassing, discriminatory, or hateful; unlawful, infringing, or in breach of third-party rights; sexually explicit or inappropriate in context; malware, phishing, or a deceptive security risk; or otherwise inconsistent with Qwixl: Streams as a thoughtful, educational, and trustworthy environment. We may use automated tools, manual review, or reports. We are not required to give reasons in every case and do not guarantee an appeal process. To the fullest extent permitted by law, we are not liable for any loss of visibility, ranking, traffic, revenue, or opportunity arising from action under this section.

Streams Student: where you connect Google Classroom, you authorise Qwixl to read your own enrolment, assignments, and submission state to provide classwork features, as described in the Privacy Policy.
