By using Qwixl you agree to these terms. If you use the service on behalf of a school or organisation, you confirm you have authority to do so.
You must use Qwixl only for lawful educational purposes. You are responsible for the content you create and the data you upload.
Safeguarding: we enforce minimum age, parental consent for under-13s, and year-group consent where required. Teachers must set the correct year group for their classes.
Milo (our Chrome extension for SEN-aware writing support) is part of the Service. Its insights are indicative only and are not a diagnosis or substitute for professional assessment.
Before you subscribe you will see the price, plan, and billing interval. We send renewal reminders before we charge you again.
You may cancel your subscription at any time from your account (Subscription) or by contacting us. There is no cancellation fee.
Subscriptions and top-ups are billed in advance. Refunds are handled in line with our refund policy. You are responsible for keeping your account secure.
You keep ownership of content you create. We need a licence to run the service (e.g. to process and display submissions and store data).
Qwixl Streams: if you publish publicly, we may remove or unpublish that content at any time if it is spam, manipulative (e.g. link farms), unlawful, or otherwise inconsistent with the Streams ethos - see the full terms.
The service is provided “as is”. Our liability is limited to the amount you paid us in the twelve months before a claim, except where law does not allow that.
Either party may end the relationship. We may suspend or terminate access with notice (or without where required for security or law).
These terms are governed by the laws of England and Wales. Disputes are subject to the courts of England and Wales (consumers may have rights in their place of residence).
Full Terms
1. Agreement to terms
By accessing or using Qwixl ("the Service"), you agree to be bound by these Terms of Service. If you are using the Service on behalf of a school or other organisation, you represent that you have authority to bind that organisation to these terms.
2. Definitions
"We", "us" and "Qwixl" mean the operator of the Service. "You" and "user" mean the person or entity using the Service. "Content" means any data, text, or materials you upload or create within the Service.
3. Use of the service
You must use Qwixl only for lawful educational purposes. You are responsible for the content you create and the data you upload. You must not attempt to circumvent security, abuse the API, or use the service in a way that harms others or violates applicable law.
4. Qwixl Streams - public content and moderation
Qwixl Streams may allow you to make content visible on public-facing pages (for example public profiles, stream pages, discovery, and related features). Public visibility is optional. Where you choose to publish, you accept that such content may be found by third parties, including search engines and other automated systems.
Our discretion to remove or restrict public content: We reserve the right, at our sole discretion and without prior notice where we reasonably consider it appropriate (including for legal, safeguarding, security, reputational, or operational reasons), to remove, unpublish, delist, restrict visibility of, or refuse to display any public Streams content, and to remove or restrict associated profiles, links, metadata, or other materials - in each case whether or not you have previously satisfied any technical or account conditions for publishing. We are under no obligation to host, publish, promote, or index any particular content.
Without limiting the generality of the foregoing, we may take such action where we reasonably consider that content or use of the Service in connection with public Streams is, for example: spam or bulk unsolicited promotion; primarily intended to manipulate search rankings, build link farms, or generate artificial traffic or authority; misleading, impersonation, or misrepresentation; harmful, abusive, harassing, discriminatory, or hateful; unlawful, infringing, or a breach of third-party rights; sexually explicit or otherwise inappropriate in context; malware, phishing, or deceptive security risk; or otherwise inconsistent with Qwixl Streams as a thoughtful, educational, and trustworthy environment (the "Qwixl Streams ethos"). We may use automated tools, manual review, or reports from users or third parties. We are not required to give reasons in every case and do not guarantee any appeal process.
This section is in addition to (and does not limit) our other rights under these Terms, including acceptable use, suspension, and termination. To the fullest extent permitted by law, we are not liable for any loss of visibility, ranking, traffic, revenue, or opportunity arising from moderation, removal, or non-publication under this section. We will handle personal data in line with our Privacy Policy where applicable.
5. Safeguarding children (contractual position)
As part of our commitment to safeguarding children, the following terms form part of this contract:
Minimum age: Children aged 9 and below cannot create a student account. We use the date of birth provided at sign-up to enforce this.
Parental consent for under-13s: Students who are under 13 at sign-up must provide a parent or guardian email. We send that adult a secure link to approve the account; the student cannot access the Service until consent is given.
Year 7, 8 and 9 (UK) and equivalent year groups: For classes designated as UK Year 7, Year 8, Year 9 (or equivalent in other curricula), only students with approved parental consent may access the class. We require consent for all students in these year groups, regardless of whether they have turned 13, because the school year runs from 1 September to 31 August and birth dates within that year vary. This ensures a single, clear rule for the whole year group and restricts access to these classes to children whose parent or guardian has consented. It also prevents older learners or adults from joining Year 7, 8 or 9 classes and accessing content intended for younger pupils.
Higher Education and senior-only classes: Students under 13 cannot join classes designated as Higher Education or senior-only (e.g. Year 12, Year 13, or equivalent). This prevents younger children from accessing content intended for older students.
Date of birth: We store students’ date of birth only for the purposes of applying these age and consent rules (including knowing when a student turns 13). See our Privacy Policy for how we use and protect this data.
By using the Service as a teacher, you agree to set the correct year group for your classes so that consent and access rules apply appropriately. By allowing your child to use Qwixl, you agree to these safeguarding terms.
6. Accounts and billing
Subscription and top-up purchases are billed in advance. Refunds are handled in line with our refund policy. You are responsible for keeping your account credentials secure.
Pre-contract information: Before you enter into a paid subscription, we will show you the price, billing interval (e.g. monthly or annual), and what is included. You can review this on our Pricing page and at checkout.
Renewal reminders: We will send you a reminder before your subscription renews (e.g. by email) so you know when the next payment will be taken. This is in line with good practice for UK subscription services.
Cancellation: You may cancel your subscription at any time. Cancellation can be done from your account (e.g. via the Subscription or billing area) or by contacting us. There is no cancellation fee. After you cancel, you will retain access until the end of the current billing period. If you cancel a free trial before it converts to paid, you will not be charged.
7. Intellectual property
Qwixl and its branding, software, and design are owned by us. You retain ownership of content you create. By using the service you grant us the licence necessary to operate the service (e.g. to process and display submissions, run marking, and store data).
8. Limitation of liability
The Service is provided “as is”. We do not guarantee uninterrupted or error-free operation. To the fullest extent permitted by law, our total liability to you shall not exceed the amount you paid us in the twelve months before the claim, except where law does not allow such limitation (e.g. death or personal injury caused by our negligence, or fraud).
9. Indemnity
You agree to indemnify and hold us harmless from any claims, losses, or costs arising from your use of the Service, your Content, or your breach of these terms, except to the extent caused by our breach or negligence.
10. Termination
You may stop using the Service at any time. We may suspend or terminate your access with notice (or without where required for security or legal reasons). On termination, your right to access the Service ceases; we will handle data in accordance with our Privacy Policy.
11. Changes to terms
We may update these terms from time to time. We will notify you of material changes via email or in-app notice. Continued use after changes constitutes acceptance. If you do not agree, you must stop using the Service.
12. Governing law and jurisdiction
These terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales, unless you are a consumer in which case you may also have rights in your place of residence.
13. Milo extension
Milo is our Chrome extension that provides SEN-aware writing support in Google Docs (typing insights, writing guides, and an optional in-doc assistant). When you use Milo, you agree to these Terms and to use it only for lawful, personal or educational support purposes.
Not diagnostic or professional advice: Milo's insights (including any indicators related to typing patterns, focus, or literacy support) are screening-style indicators only. They are not a medical, educational, or psychological diagnosis and are not a substitute for assessment by a qualified professional. You must not rely on Milo for any educational placement, health, or legal decision. We do not guarantee the accuracy, completeness, or suitability of any insight for your circumstances.
Acceptable use: You must not use Milo to harass, mislead, or harm others, or to circumvent any security or usage limits. You are responsible for how you use the insights and for any decisions you make. Our limitation of liability (section 8) and the "as is" nature of the Service apply fully to Milo.
Milo subscription: If you subscribe to Milo (paid plan), the same billing, renewal, and cancellation rights in section 6 apply. Milo is a separate subscription from Qwixl teacher/classroom plans. Pre-contract information and renewal reminders are provided in line with UK consumer law.
